Stewart Surfboards Rental Agreement and Release of Liability
I assume all risk and responsibility for any and all claim losses, damages, injuries, death or other liabilities resulting from my use and operation of the rented equipment. I understand that surfing is inherently dangerous and can result in injury as well as death. I agree to ride at my own risk. I release Stewart Surfboards, its agents, and employees from all claims.
I agree to indemnify and hold Stewart Surfboards, its agents and employees against any claims by any persons involving liability for bodily injury, death, or property damages out of my use of the rented equipment.
I have personally examined my rental equipment and acknowledge that it is in good condition and repair. I am relying entirely upon my own inspection and test; Stewart Surfboards, its agents, or employees have made no Statement or representations of any kind regarding the equipment to me.
I agree to return equipment to the store in as good condition as when I received it, normal wear and tear expected. If the equipment is not promptly returned at the end of the rental period, I agree to pay the daily rate for each day the equipment is unreturned.
I agree to pay Stewart Surfboards for any damages to the equipment beyond normal wear and tear. Damages to be decided by the store manager – not to exceed the fair retail value of the equipment but to sufficiently cover the cost of damage to equipment (repairs, replacement of fins, etc.) or to replace equipment if damaged beyond repair or if lost completely. In this case I agree to pay Stewart Surfboards the value of the replacement cost of the item. For purposes of this agreement, renter’s credit card information will be held on file and the repair or replacement cost value will be charged immediately upon inspection of the returned item(s).
I understand that rented equipment is not to be used by anyone other than myself, or if I am signing this agreement for a minor, I agree that I am responsible for this minor and I am signing the contract for them.
I agree to make no changes or alterations to the rented equipment.
I agree to use the equipment in accordance with all applicable state and local laws.
All statements above pertain to bodyboards, surfboards, wetsuits, fins, rack systems, and any other equipment rented.
All rental surfboards come equipped with a leash. If the leash is missing when the surfboard is returned, a $25 charge will be added to the price of the rental.
